Case Examples Of Why It's Important To Act Quickly

It is important to act quickly after an arrest because by law, you only have 30 days from your arrest to request a hearing or to install an ignition interlock to stop the Motor Vehicle Administration (MVA) suspension from kicking in.

Recently, I represented a state employee (again) on a DUI charge. Because he held a commercial driver's license (CDL) that he needed for his job, he was going to lose his job if convicted. After researching the case, I was successful in persuading the judge to dismiss the case.

I also represented a young man charged with a subsequent DUI just after getting off probation for an earlier one. He had an alcohol concentration three times the legal limit. I had no factual or legal defenses. He was certain that he would be doing jail time. I advised him what he needed to do prior to court. I presented to the judge various factors in mitigation. The judge suspended his sentence.

In another case, I represented a young man who was stopped for speeding and during the course of searching his car, the police found a loaded handgun in the trunk. I was able to persuade the prosecutor to drop the charges.

When reviewing the case, I will see whether the stop was lawful, whether the cop had the legal right to have you exit the car to perform the field sobriety tests, and whether he or she had the right to ask you to take the breath test. Many of the field sobriety tests are designed for you to fail and I will challenge these tests if improperly given.

In preparing for trial, I will review the police videotape of the stop if there is one. I will file pretrial motions to suppress statements and evidence, if possible, which can result in reduced or sometimes even complete dismissal of the DUI charges
